Has Ex Cathedra explain'd the animus against Orwellian langauge and other re-labellings? Wouldn't we do better if "critical thinking" were re-named "Compulsory Catechism" and the Old Testament class'd as "Crimethink"? ... and cultural paranoia deem'd "descent to the unconscious"?
Seems to me important that the Chief Justice, a member of the Federalist Society, has validated a particular vast piece of legislation but used judicial activism to give it a constitutional meaning different from the legislation's original intent.
He saved a lot of time by re-writing the legislation himself. He didn't send the legislation back to the elected branches with the advice that the Court would approve the individual mandate if it is re-legislated as a tax, rather than as a regulation of commerce. ... Perhaps also the current Congress would not pass the Affordable Health Care Act even with the individual mandate as a tax; so the Chief Justice may have saved the legislation itself.
He denies that Congress has constitutional permission to regulate the doing of nothing[ness] as a kind of commerce. Congress mayn't compel commerce. The Commerce Clause permits only the regulation of doing something, not the compelling of something.
Metaphysically or theologically, my guess is that doing nothingness is doing crypto-something or a swelling (thigh) that is (self)same, homo-self, or-and weaving TNA js2935 in a garden GN js1588 via doing exhaling js7760-62 (garlick in the A.V. Numbers 11:5)
